heath ledger has been deceased for over a year now, just before the oscars of last year. Died in 2007.

That's what I was going to say. He was in last year's Oscar 'in memoriam' segment. In fact, he was the last one shown since he died close to that Oscar time.

Everyone says that he died in 07 but he didn't he died January 22nd 2008. He had been dead exactly a year when the Oscars Nominations were announced

Regardless, they did the In Memorium segment for him last year.
